These Terms of Use form a binding agreement between the user and BioWellth. By creating an account or using the BioWellth application, users agree to these Terms. Users who do not agree should discontinue use of the service.

1. Eligibility and Acceptance

By accessing or using BioWellth, users confirm that they:

  1. Are at least 18 years old.

  2. Have read and agree to these Terms and the Privacy Policy.

  3. Have the legal capacity to enter into this agreement.

If a user accesses BioWellth on behalf of an organization, they confirm that they are authorized to accept these Terms on its behalf.

2. Description of Services

BioWellth is a digital wellness platform that helps users track and understand areas of their daily well-being. Features may include:

  1. Cycle and symptom tracking

  2. Lifestyle and wellness logging

  3. Sleep, hydration, nutrition, and mood tracking

  4. Wearable device integrations if the user chooses to connect them

  5. AI powered insights and personalized wellness recommendations

  6. Trend identification and visual summaries of wellness data

BioWellth does not provide medical advice. The platform is not a medical device or healthcare service and should not be used to diagnose, treat, or cure medical conditions. Users must consult licensed professionals for medical concerns.

3. User Accounts

3.1 Account Creation

Users may be required to create an account and provide accurate information. Users agree to:

  1. Keep login credentials confidential.

  2. Notify BioWellth of any unauthorized access.

  3. Not impersonate another person or use another person’s account.

3.2 Account Termination

BioWellth may suspend or terminate accounts that violate these Terms or create risk. Users may delete their account at any time.

4. User Responsibilities

Users agree not to:

  1. Upload false, misleading, or harmful content.

  2. Interfere with the security or functionality of the platform.

  3. Use automated tools to access or collect data.

  4. Copy, distribute, or exploit BioWellth content without permission.

  5. Use BioWellth for unlawful activities.

5. Intellectual Property

All content, AI generated insights, graphics, logos, code, and design elements within BioWellth belong to BioWellth or its licensors. Users receive a limited, personal, non transferable license to use the service for individual wellness purposes.

Users may not:

  1. Reproduce, distribute, or modify platform content.

  2. Reverse engineer, decompile, or extract source code.

  3. Use the platform for commercial or competitive purposes.

6. Data Privacy

Use of BioWellth is governed by the Privacy Policy, which explains how personal and wellness data is collected, used, and protected. By using the service, users consent to these data practices.

7. Subscriptions and Payments

Some features may require a paid subscription.

7.1 Billing

Fees may vary by region. Payments are processed securely by Stripe. Users agree to provide accurate billing information.

7.2 Automatic Renewal and Cancellation

Subscriptions renew automatically unless canceled before the renewal date. Users can cancel at any time through their account settings or the app store. Refunds are granted only as required by law.

8. Disclaimers

BioWellth provides wellness insights for informational purposes only. BioWellth does not guarantee specific health outcomes or results.

BioWellth is not responsible for:

  1. Inaccuracies in user entered information.

  2. Data from third party wearables or integrations.

  3. Availability of third party systems.

  4. Service interruptions or technical issues.

Users assume responsibility for decisions related to their well-being.

9. Limitation of Liability

To the fullest extent permitted by law, BioWellth is not liable for:

  1. Direct, indirect, incidental, or consequential damages arising from use of the service.

  2. Inaccuracies in wellness insights or third party data.

  3. Unauthorized access that occurs despite reasonable safeguards.

  4. Loss of data or service interruptions.

If liability is found, the total amount owed by BioWellth will not exceed the amount paid by the user during the previous twelve months.

10. Indemnification

Users agree to indemnify, defend, and hold harmless BioWellth, including its officers, directors, employees, and partners, from any claims, losses, damages, liabilities, costs, or expenses arising from:

  1. Use of the platform,

  2. Violation of these Terms, or

  3. Infringement of the rights of any third party.

11. Third Party Services

BioWellth may integrate with third party services such as wearable providers or Apple Health. BioWellth is not responsible for the content, functionality, or data handling practices of these third party services. Use of third party integrations is governed by their independent terms and policies.

12. Dispute Resolution

Users agree to first attempt to resolve disputes informally by contacting BioWellth. If unresolved, disputes will be handled through binding arbitration in the jurisdiction where BioWellth is registered. Users waive participation in class actions.

13. Governing Law

These Terms are governed by the laws of the region where BioWellth is legally established, unless local laws require otherwise.

14. Modifications to These Terms

BioWellth may update these Terms periodically. Users will be notified of material changes. Continued use after changes indicates acceptance of the updated Terms.

16. Entire Agreement
